Welcome to the Nebraska Child Support Calculator. This product was developed by Adam Astley, and is offered to the public through Advanced Legal Software, LLC, a Nebraska Limited Liability Company (hereinafter "Advanced"). Neither Advanced nor this product is not affiliated with any other Child Support calculation software, nor is either affiliated with any branch or department of the State of Nebraska.
By using the Nebraska Child Support Calculator (hereinafter the "Calculator"), you agree to be bound by the terms contained within this document. Advanced will not accept any changes, additions, or deletions to this agreement.
The Calculator is intended to assist you in preparing child support worksheets that conform to the Nebraska Child Support Guidelines. Advanced sincerly hopes that you will find this product useful and effective in your practice, however, this product is offered "AS IS" AND WITHOUT ANY WARRANTIES OF ANY TYPE, WHETHER EXPRESS OR IMPLIED. In no event shall Advanced or the author be liable for any special, incidental, or consequential damages arising out of or in connection with the Calculator, however arising, including negligence. In any event, Advanced's liability to you shall be limited to the annual licensing fee paid for the applicable year.
This product is licensed on an annual basis for an annual licensing fee. The annual fee shall be determined at the time that you create or renew your account with the Nebraska Child Support Calculator. Advanced may adjust the annual fees from time to time, however, such adjustments shall take effect only for users that create a new account, or renew an existing subscription after the date of the adjustment.
Annual license fees will not be pro-rated, or refunded for any reason.
Upon your payment of the annual license fee, Advanced grants to you a non-exclusive, limited license to use the Calculator software for the sole purpose of preparing Child Support Calculations and related functions. This license is subject to the restriction that, except where expressly permitted by law, you may not translate, reverse-engineer or reverse-compile or decompile, disassemble or make derivative works from the Calculator. You may not modify the Calculator or use it in any way not expressly authorized by this agreement.
During the term of its contract with the NSBA (or any renewals of that contract), the NSBA will pay a single annual license fee on behalf of all of its members, and the NSBA will be deened to be Advanced's customer.
Advanced's introduction of various technologies may not be consistent across all platforms or browsers and the performance of some features may vary depending on your computer software, internet connection, and other equipment.
The Calculator is "Internet Based." It requires your internet connection and our internet connection to be working properly. Advanced will take reasonable steps to ensure system availability, however, it shall not be responsible for interruptions in service, or for any incidental or consequential damages that arise from interruptions in service.
This agreement, and any licenses granted hereunder shall be governed by the laws of the State of Nebraska. You expressly agree that exclusive jurisdiction for any claim or dispute with Advanced regarding or in any way relating to your use of the Calculator shall reside in the Courts of the State of Nebraska. You further consent to the exercise of Personal Jurisdiction over yourself by the Nebraska courts in connection with any such dipsute.
A Note to Self-Represented Litigants (sometimes called Pro Se Parties)
Although the author is an attorney, your use of this product is not a substitute for seeking the personalized legal advice of an attorney licensed to practice in your jurisdiction. It is your responsibility to learn and understand the law, and to present the Court with Child Support worksheets that are supported by the law and the facts of your case. Furthermore, by offering this product to the public, it is not the author's intention to create an attorney-client relationship with any user.
This website uses forms that allow you to enter contact information, including your name, email address, firm name, and a password. Advanced retains your name, email address, firm name, and IP in our database to verify that your account is valid, and that you have consented to these Terms of Service. Your password is "hashed" using an md5 algorithm before it is stored in our database. This means only an encrypted version of your password is stored. Advanced will not have access to the human-readable password that you supply when you create your account. Advanced cannot recover lost passwords. If you forget your password, a random one will be generated for you.
Users under the NSBA's member benefit program will have special accounts created. These accounts will contain the user's name, a unique identifier shared with the NSBA, and such other information required to differentiate the user from other users.
Most users will pay for their account using PayPal's merchant processing services. PayPal collects additional information for billing and verification purposes, and the retention and dissemination of that information is governed by PayPal's polices.
The Calculator uses one (1) cookie called PHPSESSID, which is transmitted to your web browser. The Calculator will not operate unless this cookie is accepted. The purpose of this cookie is to maintain your account information, and to temporarily store the data you enter into the calculator for the duration of your session. The cookie is destroyed, and all information associated with the cookie is erased when you logout of your session. By default, information that you enter into the Calculator is not preserved from session to session unless you choose to save the calculation as is explained below.
The Calculator includes the capability to save calculations on the server. By default, your calculations will not be saved. If you choose to save any of your calculations, all of the data that you have input for that calculation, as well as the date and time that you entered the data, will be saved on the server. The data will remain on the server until you delete it, or until Advanced deletes it. Advanced may, but shall not be required to make backup copies of the calculations that you save on the server. You should not rely on Advanced's server as the only method to store sensitive or important information. The capability to save calculations is provided for your convenience, but is not intended to provide long-term or reliable data storage.
Advanced logs information from its Apache web server, including information that could potentially identify you such as your IP address, the request string, and date and time of each request. This information is recorded for troubleshooting purposes, and to investigate potential breaches of Advanced's servers. It is discarded from time to time after it is no longer needed.
Advanced may store other information that you provide to it using other methods such as telephone contact, written correspondence, email, etc. If you contact Advanced for customer or technical support, Advanced may keep a record of the support that was given.
Advanced may also use your name and firm name in devising marketing strategies, such as deciding upon geographic locations in which to focus marketing, or other similar purposes. Advanced will not advertise your status as a subscriber to others without first obtaining your permission to do so.
Advanced is required under its contract with the NSBA to furnish periodic usage reports. These reports will not contain any information to personally identify your use of the Calculator, however such reports will contain aggregate data showing number of users, frequency of use, login times, etc. Information gathered about your individual use will be included in this data but will not be individually identifiable to you. Information that you provide for individual calculations will not be furnished as part of this reporting process.
Advanced will cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Advanced will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe is necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical.
If your account is cancelled (either voluntarily or involuntarily), any information that Advanced had collected from you will be retained until Advanced determines, in its sole discretion, that the retention of such information no longer serves a business purpose. At that time, the information may be deleted. Your information may be retained for a period of time that Advanced determines to be reasonable to comply with its legal obligations, resolve disputes, or enforce its agreements.
Advanced reserves the right to change this policy at any time. If Advanced elects to change this policy, it will post the changes to these Terms of Service, and other places that it deems appropriate so that you are aware of the new policy. Advanced will post all changes to its policy at least thirty (30) days prior to the date that the changes take effect.
